1. Your Enrolment

1.1 By enrolling on a course with Motion Fitness Education Ltd ("MFE", "we", "us", "our"), you are entering into a binding agreement with us on the terms set out in this document.

1.2 You must be aged 16 or over to enrol. Where a course has a prerequisite qualification, it is your responsibility to ensure you meet that requirement before enrolling. If you enrol on a course for which you do not hold the required prerequisite, MFE reserves the right to cancel your enrolment and issue a refund, less any administration costs incurred.

1.3 You will not be able to access your course materials until these Terms and Conditions have been accepted.

1.4 Completion timescales: You are responsible for completing your course within 2 years of your enrolment start date, regardless of qualification level. If you have not completed your course within this period, MFE reserves the right to archive your enrolment.

1.4a If you wish to reactivate an archived enrolment, please contact our team. Reactivation beyond the 2-year period may incur additional fees. Any fees applicable will be confirmed by our team at the time of your reactivation request.

1.5 Bundle enrolments: Where you have purchased a bundle comprising more than one qualification (for example, a combined Level 3 and Level 4 pathway), the 2-year completion timescale applies from the date of your original enrolment. In addition, where a bundle includes a subsequent qualification that begins after the completion of a prior one, you must book the subsequent qualification within 2 years of your original enrolment start date.

If you complete the first qualification but do not book the subsequent qualification within this period, you will forfeit your entitlement to the remaining qualification(s) included in the bundle and no refund will be due for any unused element. If you are approaching the 2-year limit and have not yet booked a subsequent qualification, please contact our team as early as possible to discuss your options. Once a subsequent qualification has been booked, any request to change, reschedule or transfer that booking will be subject to the £100 administration fee set out in clause 4 (Course Transfers).

2. Payment

2.1 Course fees are due at the time of enrolment unless you have agreed a payment plan with MFE.

2.2 Payment methods: MFE accepts payment via the following methods:

- Card payments — processed securely via our card payment provider (currently Stripe or an alternative authorised payment gateway, as displayed at checkout)

- PayPal — available as an alternative checkout method

- Direct Debit — for payment plan instalments, collected via GoCardless

2.3 Payment plans: Where a payment plan is available and selected, you are entering into an agreement to pay the outstanding balance in full over the agreed number of instalments. Selecting a payment plan does not reduce the total amount owed — it spreads the cost only. By enrolling on a payment plan, you commit to paying all instalments in full.

2.4 Missed payments: If a payment plan instalment is missed or a Direct Debit is returned unpaid, your access to your course will be temporarily suspended until the outstanding payment is received. MFE will attempt to contact you to resolve the matter. If an outstanding balance remains unresolved following reasonable attempts to contact you, MFE reserves the right to pass the debt to a third-party collections agency to recover the amount owed. Any costs reasonably incurred in recovering an outstanding balance may be added to the amount due.

2.5 Certificates and completion: Your certificate of qualification will not be issued until your course fees have been paid in full. If you are on a payment plan, you may choose to pay off your outstanding balance early at any time in order to receive your certificate sooner.

2.6 All prices are inclusive of VAT where applicable. MFE reserves the right to amend course fees at any time, but the price applicable to your enrolment is the price confirmed at the time you enrolled.

3. Cancellation and Refunds

3.1 Your right to cancel (14-day cooling-off period) Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you have the right to cancel your enrolment within 14 days of the date your enrolment is confirmed, without giving any reason.

3.2 Accessing materials before the cooling-off period ends MFE provides immediate access to course resources upon enrolment. Course resources may include e-learning content, online learning portals, downloadable materials and hard copy manuals. By accessing any course resources — whether digital or physical — before the 14-day cooling-off period has expired, you acknowledge that you are requesting the service begins immediately. In this case:

- You retain your right to cancel, but any refund will be reduced to reflect the proportion of the course already received

- If you have accessed all or substantially all of the course resources or content, no refund may be due

- If hard copy manuals or other physical resources have been dispatched, their cost will be deducted from any refund

3.3 Attending a face-to-face session before the cooling-off period ends Attending an in-person training day, practical session or workshop as part of your course before the cooling-off period expires also constitutes receipt of part of the service. Any refund will be reduced proportionally to reflect the value of the session attended. Where a face-to-face element constitutes the entirety of the course (for example, a one-day in-person workshop), attendance means the service has been fully delivered and no refund will be due.

3.4 How to cancel within the cooling-off period To cancel, you must notify us in writing before the 14-day period expires by emailing [email protected] with the subject line: Cancellation Request — [Your Name] — [Course Name]. We will acknowledge your request within 2 working days and process any eligible refund within 14 days.

3.5 Cancellation after the 14-day cooling-off period After the cooling-off period has expired, we are unable to offer a refund except in exceptional circumstances (see clause 3.6). Nothing in these Terms affects your statutory rights.

3.6 Exceptional circumstances If you are unable to continue your course due to a serious, documented change in personal circumstances (such as a significant medical issue or bereavement), please contact our team to discuss your situation. We will consider requests on a case-by-case basis and, where possible, offer a study pause, a course transfer or another appropriate resolution.

4. Course Transfers

4.1 If you wish to transfer your enrolment to a different MFE course, please contact our team as soon as possible.

4.2 Transfers within 14 days of enrolment are treated as a cancellation and fresh enrolment. No transfer administration fee applies during this period. Any difference in course price will be charged or refunded as appropriate, subject to the conditions on accessed materials and attended sessions in clause 3 above.

4.3 Transfers after 14 days of enrolment are subject to a £100 administration fee, payable at the time the transfer is processed. This fee covers the administrative cost of processing your transfer, updating your enrolment records and registering you with the relevant awarding organisation for your new course. Any difference in course price in excess of the administration fee is payable by you.

4.4 The £100 administration fee is non-refundable once a transfer has been processed.

4.5 Course transfers are subject to availability and are at MFE's discretion. We reserve the right to decline a transfer where the requested course is not suitable given your prior qualifications, learning or circumstances.

5. Your Responsibilities as a Learner

5.1 Assessment materials and course resources: It is your responsibility to retain a copy of all submitted work — including workbooks, worksheets and video assessments — before uploading for assessment. MFE cannot be held responsible for any work that is lost or corrupted after submission. You should retain copies until your certificate has been received. Where your course includes e-learning content or hard copy manuals, it is also your responsibility to retain access to or keep safe any course resources provided to you throughout your study.

5.2 Client work: Where your course requires you to work with a client (for example, in personal training or sports massage qualifications), it is your responsibility to select a suitable client and to ensure that any work with that client is conducted safely, ethically and within your current level of competency. MFE cannot be held responsible for any situation arising from client interactions conducted as part of your course.

5.3 Disclosure of additional needs: It is your responsibility to inform MFE of any reason that you may require additional support, reasonable adjustments or cannot complete specific elements of your course. This information should be declared on your student registration form or disclosed to our team as early as possible in your enrolment. If you do not disclose a relevant need at the point of enrolment or as soon as it becomes apparent, MFE reserves the right to take this into account when considering any subsequent complaint or appeal.

5.4 Course prerequisites: It is your responsibility to ensure you hold any prerequisite qualifications required for your chosen course before enrolling. MFE will not be held liable for any loss incurred if you enrol on a course for which you do not hold the required prerequisites.

6. Complaints and Appeals

6.1 In the event that you wish to make a complaint or appeal an assessment decision at any point during your course, you must follow MFE's Complaints and Appeals Policy, which is available within the course administration section of your learning portal.

6.2 Any complaint or appeal must be submitted in accordance with that policy and within the timeframes specified. MFE will not consider complaints or appeals submitted outside those timeframes or through channels not specified in the policy.

7. Awarding Organisations and Certification

7.1 MFE's qualifications are awarded by recognised awarding organisations, including Focus Awards, YMCA Awards, Transcend Awards and formally Active IQ and are regulated by Ofqual. By enrolling on a course, you agree to be bound by the relevant awarding organisation's own learner terms and requirements, which will be communicated to you as part of your enrolment.

7.2 Your qualification certificate will be issued by the relevant awarding organisation and dispatched to you upon successful completion of your course and receipt of full payment. MFE cannot issue certificates on behalf of awarding organisations outside their standard processes.

8. ELCAS Funding

8.1 Learners wishing to use Enhanced Learning Credits Administration Service (ELCAS) funding towards their course must inform MFE before enrolment to confirm eligibility and arrange the appropriate payment process. ELCAS-funded enrolments may be subject to additional conditions in line with ELCAS requirements.

9. Limitation of Liability

9.1 To the fullest extent permitted by law, MFE's total liability to you in connection with your course enrolment shall not exceed the total fees paid by you for that course.

9.2 MFE shall not be liable for any indirect, consequential or special losses arising from your enrolment, including but not limited to loss of income, loss of business opportunity or failure to achieve a particular career outcome.

9.3 Nothing in these Terms limits MFE's liability for death or personal injury caused by our negligence, fraud or any other liability that cannot be excluded by law.

10. Data Protection

10.1 MFE processes your personal data in accordance with our Privacy Policy. By enrolling, you acknowledge that we will process your personal data as described in that policy, including sharing relevant data with our awarding organisations for the purpose of registering and certificating your qualification.

11. Changes to These Terms

11.1 MFE reserves the right to update these Terms and Conditions from time to time. Any changes will be published on our website and will apply to enrolments made after the date of publication. Your enrolment is governed by the version of these Terms in force at the time you enrolled.

12. Governing Law

12.1 These Terms and Conditions are governed by the laws of England and Wales. Any disputes arising from your enrolment that cannot be resolved by agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Your Statutory Rights

13.1 Nothing in these Terms and Conditions affects your statutory rights as a consumer under UK law. For more information about your consumer rights, visit citizensadvice.org.uk.
